Overview
An AAT Review allows eligible applicants to request an independent review of certain visa refusals or cancellations made by the Department of Home Affairs. The Tribunal reviews the decision afresh, meaning it can consider new evidence in addition to what was originally submitted.
Who this review is for
You may be eligible for an AAT review if:
- Your visa application was refused or your visa was cancelled
- The refusal/cancellation is reviewable by the AAT
- You lodge the review within the strict time limit stated in the decision letter
What the AAT considers
An AAT review typically examines:
- Whether the original decision was legally correct
- Whether the visa criteria were properly assessed
- Any new or additional evidence you provide
- Whether discretion (if applicable) should be exercised differently
